Welcome to Sendez Deliveries! These Terms of Service (“Terms”) govern your access to and use of our mobile applications: ‘Sendez’ for customers and ‘SuperSend Pilot’ for riders, collectively referred to as the “Service,” operated by Sendez Deliveries LTD (“Sendez,” “we,” “us,” or “our”).

 

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please refrain from using our Service.

1. Definitions

  • User: Any individual or entity using the ‘Sendez’ application to request delivery services.
  • Rider or Partner: Individuals using the ‘SuperSend Pilot’ application to accept and fulfill delivery orders.
  • Package(s) or Goods: Items eligible for delivery through our Service, subject to the specifications and restrictions outlined herein.
  • Service: The collective functionalities provided through both ‘Sendez’ and ‘SuperSend Pilot’ applications.
  • Territory: The geographical area within which Sendez operates, currently limited to Rivers State, Nigeria.

 

2. Service Description

Sendez provides a platform connecting Users seeking delivery services with Riders available to fulfill those requests. Our Service includes:

  • Immediate Delivery: Riders pick up Goods from the User’s specified location and deliver directly to the designated drop-off point without additional stops.
  • Scheduled Delivery: Riders pick up Goods and deliver them at the specified date and time of the user

 

3. User Responsibilities

Users agree to:

  • Provide accurate and complete information when placing delivery requests.
  • Ensure that Goods are properly packaged to withstand transit.
  • Verify that Goods comply with all applicable laws and do not include prohibited items (see Section 5).
  • Be available or ensure a designated recipient is available at the delivery location within the agreed timeframe.

 

4. Rider Responsibilities

Riders are expected to:

  • Maintain valid identification and any required licenses or permits for delivery operations.
  • Ensure timely pick-up and delivery of Goods as per the selected service option.
  • Handle Goods with care to prevent damage or loss.
  • Comply with all traffic regulations and maintain the safety of themselves and others during deliveries.

 

5. Prohibited Items

The following items are prohibited from being delivered through our Service:

  • Illegal substances or items prohibited by law.
  • Hazardous materials, including explosives, flammable liquids, and toxic substances.
  • Perishable goods not properly packaged or labeled.
  • Items exceeding the weight and size limitations of the rider’s package carrier.

Sendez and its riders reserve the right to refuse the delivery of any Goods that violate these terms or are deemed unsafe.


 

6. Account Registration and Security

Both Users and Riders must:

  • Create an account by providing accurate, complete, and current information.
  • Maintain the confidentiality of their account credentials.
  • Notify Sendez immediately of any unauthorized use or security breaches.

Sendez reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activities.


 

7. Payment Terms

  • Users: Agree to pay all fees associated with the delivery services as displayed at the time of the order. Payments are either made in cash or processed through approved methods within the application.
  • Riders: Will collect all fees associated with any delivery order they accept and complete. Sendez reserves the right to adjust compensation rates and will provide notice of any changes.

 

8. Cancellations 

  • Users: May cancel delivery requests before a Rider has accepted the order without incurring charges. Cancellations after acceptance may result in a fee.
  • Riders: If unable to complete a delivery due to unforeseen circumstances, must notify Sendez promptly. Repeated cancellations may lead to account review or termination.

 

9. Intellectual Property Rights

All content, trademarks, and features within the Service are the exclusive property of Sendez and its licensors. Users and Riders may not copy, modify, distribute, or reverse engineer any part of the Service without explicit permission.


 

10. Limitation of Liability

Sendez is not liable for:

  • Indirect, incidental, or consequential damages arising from the use of the Service.
  • Unauthorized access to or alteration of your transmissions or data.
  • Any content or conduct of third parties using the Service.

Our total liability is limited to the amount paid by the User for the specific delivery in question, and a maximum of 100, 000 naira or as specified in our GIT insurance coverage in the event of a package loss or damage after an exhaustive and conclusive investigations.


 

11. Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to these practices.


 

12. Changes to These Terms

We may update these Terms periodically. Material changes may or may not be communicated through the application or via email, with at least 30 days’ notice. Continued use of the Service after such updates constitutes acceptance of the new Terms.


 

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the use of the Service will be resolved through mediation or arbitration in Rivers State, Nigeria.
